Applicability

18 U.S.C. § 2257 requires record-keeping for content that depicts actual sexually explicit conduct involving real individuals as defined by 18 U.S.C. § 2256. Where such content exists on the Platform, the operator maintains all required records pursuant to 28 C.F.R. Part 75.

Content that does not depict actual sexually explicit conduct by real individuals — including non-explicit material, text, audio, and digitally produced content — is exempt from 2257 requirements. May Secrets qualifies for additional exemptions under 18 U.S.C. § 2257(h)(2)(B)(v).
